1. Introduction
At SizeMarker, we respect your right to control your personal data. This Data Deletion Policy explains how you can request the deletion of your personal information from our systems, what data can be deleted, and the process we follow to fulfill your request.
This policy applies to all users of SizeMarker services, regardless of location. We are committed to complying with applicable data protection laws, including the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other relevant privacy regulations.
2. Your Right to Deletion
You have the right to request the deletion of your personal data held by SizeMarker. This right is recognized under various data protection laws:
- GDPR Article 17 (Right to Erasure): Also known as the "right to be forgotten," this allows EU/EEA residents to request deletion of their personal data under certain circumstances.
- CCPA Section 1798.105 (Right to Delete): California residents have the right to request deletion of personal information collected by businesses.
- Other Jurisdictions: Similar rights may exist under other applicable privacy laws in your jurisdiction.
We will honor valid deletion requests regardless of your location, subject to any legal obligations that require us to retain certain data.
3. Data We Can Delete
Upon receiving a valid deletion request, we can delete the following types of personal data:
3.1 Account Information
- Name and email address
- Username and profile information
- Account preferences and settings
- Login credentials (passwords are stored in hashed format)
3.2 Usage Data
- Activity logs and usage history
- Feature interaction records
- Session information
- Device and browser information
3.3 Content Data
- Videos and images you have uploaded
- Annotations and project files
- Saved templates and presets
- Export history
3.4 Communication Data
- Support ticket history
- Email communication records
- Feedback and survey responses
4. Data Retention Requirements
Certain data may be retained even after a deletion request due to legal, regulatory, or legitimate business requirements:
- Financial Records: Transaction and payment records may be retained for up to 7 years as required by tax and accounting laws.
- Legal Obligations: Data required to comply with legal obligations, resolve disputes, or enforce our agreements.
- Fraud Prevention: Limited data may be retained to prevent fraud, abuse, or violations of our Terms of Service.
- Aggregated Data: Anonymized or aggregated data that cannot be used to identify you may be retained for analytics purposes.
When we cannot fully delete your data due to these requirements, we will inform you of the specific reasons and the expected retention period.
5. How to Request Data Deletion
You can request deletion of your data through any of the following methods:
5.1 In-App Deletion
The easiest way to delete your account and data:
- Log in to your SizeMarker account
- Navigate to Settings → Account
- Click "Delete Account"
- Confirm your request by entering your password
- Your account will be scheduled for deletion
5.2 Email Request
Send a deletion request to support@sizemarker.com with the following information:
- Subject line: "Data Deletion Request"
- Your registered email address
- Your account username (if applicable)
- A clear statement requesting deletion of your data
- Any specific data you want deleted (or "all data" for complete deletion)
5.3 Facebook Data Deletion Callback
If you signed up using Facebook Login, you can also request data deletion through Facebook:
- Go to your Facebook Settings & Privacy → Settings
- Navigate to Apps and Websites
- Find SizeMarker and click "Remove"
- This will trigger a data deletion request to our systems
6. Verification Process
To protect your data from unauthorized deletion requests, we verify your identity before processing any deletion request:
- Email Verification: We will send a confirmation email to your registered email address. You must click the confirmation link to proceed.
- Account Verification: For requests made while logged in, your current session serves as verification.
- Additional Verification: For requests involving sensitive data or made by authorized agents, we may request additional proof of identity.
We will not process deletion requests that we cannot verify. This protects you from malicious deletion attempts by unauthorized parties.
7. Processing Timeline
Once we receive and verify your deletion request, we follow this timeline:
- Acknowledgment: Within 3 business days, we will acknowledge receipt of your request.
- Processing: We will process your request within 30 days (or one month under GDPR).
- Grace Period: After initiating account deletion, there is a 30-day grace period during which you can cancel the request and recover your account.
- Permanent Deletion: After the grace period, your data will be permanently deleted from our active systems within 30 days.
- Backup Systems: Data in backup systems will be purged within 90 days of permanent deletion.
For complex requests or those involving large amounts of data, we may extend the processing time by up to two additional months. We will notify you if an extension is necessary.
8. Third-Party Data
When you request data deletion, we will also take steps to address data held by third parties:
- Service Providers: We will notify our data processors (such as cloud hosting providers) to delete your data from their systems.
- Payment Processors: Payment information processed by Stripe or other payment providers is subject to their data retention policies. We will request deletion where possible, but some financial records may be retained for compliance purposes.
- Analytics Services: Data collected by analytics services (such as Google Analytics) may be anonymized rather than deleted, as we do not have direct deletion capabilities for all third-party services.
Please note that once data has been shared with third parties in accordance with our Privacy Policy, we cannot guarantee complete deletion from all third-party systems.
9. Effects of Data Deletion
Please be aware of the following consequences before requesting data deletion:
- Account Termination: Complete data deletion will result in permanent closure of your SizeMarker account.
- Loss of Content: All your uploaded videos, annotations, projects, and saved work will be permanently deleted and cannot be recovered.
- Subscription Cancellation: Any active subscriptions will be cancelled. Refunds are subject to our refund policy.
- Service Access: You will lose access to all SizeMarker services and features.
- Data Recovery: After the grace period, deleted data cannot be recovered under any circumstances.
We recommend downloading or exporting any data you wish to keep before requesting deletion. You can export your projects and data from the account settings page.
